Welcome & Introduction
Welcome to Fuelwheel! These Terms of Use ("Terms") govern your download, access, and use of the Fuelwheel Android application ("App"), developed and operated by Mentaxis Labs, a company based in India.
By installing, accessing, or using Fuelwheel, you signify your legally binding acceptance of these Terms. If you do not agree to these Terms, you must immediately cease using and uninstall the App. You represent that you are of legal age in your jurisdiction to form a binding contract.
License to Use the App
Mentaxis Labs grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use Fuelwheel strictly for your personal, non-commercial purposes on compatible Android devices.
Personal use only. You may not use Fuelwheel for commercial purposes, such as managing third-party commercial fleets, reselling the App, or integrating it into enterprise vehicle management systems without explicit written consent from Mentaxis Labs.
Prohibited actions. You agree not to copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of the App or any part thereof.
User Accounts & Cloud Data Storage
Unlike apps that store data strictly locally, Fuelwheel utilizes secure, third-party cloud infrastructure to safely store, synchronize, and back up your fuel logs, vehicle data, and expenses.
Network requirements. For cloud syncing to operate correctly, your device must have an active internet connection. You are solely responsible for any mobile data or ISP fees incurred while using the App.
Data integrity & backups. While we use robust cloud infrastructure to ensure your data is safely stored across devices, we do not guarantee absolute immunity from server outages or network failures.
Data accuracy. Fuelwheel relies on the data you input (e.g., odometer readings, fuel prices, expenses). You are solely responsible for the accuracy and completeness of this data. Mentaxis Labs is not responsible for incorrect calculations or reports resulting from user-generated input errors.
In-App Purchases & Subscriptions
Fuelwheel is distributed exclusively via the Google Play Store for Android.
Payment processing. All payments, premium feature unlocks, and subscriptions are handled natively by Google Play. Mentaxis Labs does not collect, process, or store your credit card or payment information.
Renewals & cancellations. Subscriptions automatically renew unless canceled through your Google Play account settings prior to the end of the current billing cycle.
Refunds. Any requests for refunds must be directed to the Google Play Store and are subject to Google's refund policies. Mentaxis Labs cannot issue refunds directly.
Intellectual Property Rights
The App — including its original content, visual interfaces, interactive features, graphics, design, compilation, and computer code — is the exclusive property of Mentaxis Labs and is protected by international copyright, trademark, and other intellectual property laws. You may not use our brand, logos, or designs without prior written permission.
Third-Party Services
The App integrates third-party services for essential functions, including but not limited to hosting, cloud database infrastructure, analytics (e.g., Google Firebase), and app distribution (Google Play Services). Your use of the App is also subject to the terms and privacy policies of these respective third-party service providers.
Disclaimers of Warranty
The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Mentaxis Labs expressly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The App will function uninterrupted, secure, or free of errors or bugs.
- The results, calculations, or analytics provided by the App will be perfectly accurate or reliable.
- Any errors or defects in the App will be immediately corrected.
Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Mentaxis Labs, its directors, employees, partners, or agents be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of profits, data loss, vehicle-related financial losses, or other intangible losses resulting from:
- Your access to, use of, or inability to access or use the App.
- Unauthorized access to or alteration of your cloud-stored data.
- Any reliance placed by you on the completeness or accuracy of the App's calculations.
Indemnification
You agree to defend, indemnify, and hold harmless Mentaxis Labs and its team from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your misuse of the App.
Modifications to the App & Terms
Mentaxis Labs reserves the right to modify, suspend, or discontinue the App (or any features within it) at any time without prior notice. We may also revise these Terms occasionally. The most current version will always be posted within the App or on our website. By continuing to access or use the App after revisions become effective, you agree to be bound by the revised Terms.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Gujarat, India, and you hereby irrevocably consent to the personal jurisdiction and venue therein.
